NOTE:
1. Plaintiff may obtain a judgment on the subject real property consistent with the relief prayed for in the Complaint, and no money judgment is awarded as against Defendant, HUD. 2. The interests of Defendant, HUD, herein are subordinate to the interests of Plaintiff. 3. Plaintiff and Defendant, HUD, shall bear their own costs and attorney’s fees incurred in this case. 4. This stipulation does not bar, extinguish, and/or waive Defendant, HUDs claim to any potential excess proceeds available following any foreclosure sale. 5. Absent the completion of any Sheriff’s sale, Defendant, HUD’s rights and interest in the Property and its lien thereon shall remain unaffected by the Judgment in this case and shall be in full force and effect. 6. The judgment in this matter and Sheriff’s sale, if any, shall not affect Defendant, HUDs (including its affiliates, investors, predecessors, successors, assigns, authorized agents, or other holders of the promissory note secured by the aforementioned deed of trust) rights and remedies as to the borrower(s) under the promissory note, in any other way; and 7. Plaintiff shall provide to Defendant, HUD, a copy of any judgment and Decree of Foreclosure issued in this matter.
