Protocol and Practice of Persons Appearing in the Court of Commissioner David Keys-Nunes
Pre-Trial Practice and Management Issues
Motion Practice
When filing an expedited motion for consideration by the Court, please attempt to contact the other parties to the case. Include their positions or your attempts to contact them in the motion before the Court.Artificial intelligence can be a powerful tool, but it has limitations. Parties and counsel must ensure whatever is submitted to the Court complies with the rules of procedure and is factually and legally accurate.
Trial Practice and Protocol
Trial Practice and Procedure
Many of the trials and hearings before the Court are scheduled as remote appearances. It is each party's responsibility to know how to manage their exhibits, including sharing their screen so witnesses can see exhibits. It is a worthwhile exercise to practice screen sharing in the Microsoft Teams application before beginning your hearing. If you intend to appear at a remote hearing by telephone, your ability to see or engage with exhibits is greatly degraded. This is not ordinarily sufficient cause to postpone a hearing. If your presentation includes voluminous exhibits, please be prepared to identify the specific pages and their relevance you would like the Court to consider. For lengthy audio or video files, please be prepared to identify by time stamps the periods and their relevance you would like the Court to consider.
