Protocol and Practice of Persons Appearing in the Court of Commissioner Annielaurie Van Wie

Specific Comments or Advice for Litigants

Specific Requirements or Preferences

For EDC Court, for a first continuance you may file a motion with the opposing side's position and if you have the plea, discovery and waive time, I will give one continuance. Further continuances will be called on the record and only granted in exceptional circumstances. If you need continuance dates, look on the sheet on counsel's table at the presumed dates. If that doesn't work, talk to my CA to select a date that works for the calendar. If there is restitution in a plea, at sentencing be prepared to tell me if your client waives their appearance for any restitution hearing. Typical hearings are very short, for longer hearings, let us know you want a block of time, and we will set them at the end of the calendar, if granted. Be polite to staff and others in court and make sure to let the opposing side know what is going on, it makes the court time move smoother and faster. This is a very high-volume docket, so be prepared for it to move fast.

Motion Practice

Make sure to email filed motions and sentencing memos to my JA so we get them in a timely manner. The calendar is very compressed in terms of court settings so this is the best way to make sure we have the information, instead of waiting for it to filter through the electronic filing system. Still file the pleading via the normal process, we will not file your documents.
