MINUTE ENTRY

The Court having taken the following motions under advisement after oral argument on February 18, 2009 and being fully informed in the premises makes the following orders.

IT IS ORDERED denying Defendants’ Motion to Dismiss Complaint of Andrew P. Thomas in his official capacity of Maricopa County Attorney in this matter.

IT IS ORDERED granting Defendants’ Motion to Dismiss Joseph Arpaio in his official capacity as Sheriff of Maricopa County, Arizona as there has been no showing that he has any standing to bring this action.

IT IS ORDERED granting Defendants’ Motion for Order for Disclosure of Conflicts. Plaintiff is ordered to submit in writing all disclosures required under the Arizona Rules of Professional Conduct, Rule 42, Rules of the Supreme Court of Arizona, and specifically ER 1.6 and 1.7 of those rules within twenty (20) days of the date of this order. If the County Attorney refuses to make appropriate disclosures as hereby ordered or if in the Court’s judgment they are inadequate, such action may result in the dismissal of this case.
