Juveniles accused of serious crimes or thought to be risks to public safety can be prosecuted as adults. Not all juveniles accused of illegal acts are prosecuted in Juvenile Court. Arizona law requires that under certain conditions (based on the offense alleged and the juvenile's age and offense history) the county attorney MUST file charges against the juvenile in adult criminal court. In certain other situations the state MAY file adult charges. These are referred to as Direct Files. If the juvenile and/or his offense history do not meet the requirements for a Direct File, the County Attorney may file a Request for transfer, in which the state is asking the Juvenile Court to Remand" the juvenile to criminal court for prosecution as an adult.
